1. Overview

UPIC (“we,” “our,” or “us”) provides an AI-powered portrait generation service available at upic.ai. These Terms of Service (“Terms”) govern your access to and use of our website, applications, and services (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. The Service

UPIC allows you to upload a personal photo and generate AI-styled portrait variations. Key aspects of the Service include:

• Photo Upload. You upload a photo of yourself to generate AI-styled portraits.
• AI Generation. Our AI generates portrait variations based on your uploaded photo and selected style preferences. Image generation is powered by fal.ai.
• Preview & Purchase. Generated images are shown with a watermark. You may preview them for free and purchase the ones you want to keep.
• Pricing. Each unwatermarked portrait costs $1.00 USD. Payment is processed through Stripe.
• Auto-Deletion. Uploaded photos and generated images are automatically deleted from our servers within 24 hours.

3. User Responsibilities

By using the Service, you represent and agree that:

• You are at least 18 years of age or have parental/guardian consent.
• You will only upload photos of yourself or photos you have explicit permission to use.
• You will not upload photos of minors, celebrities, or other individuals without their consent.
• You will not use the Service to create deceptive, fraudulent, defamatory, or harmful content.
• You will not attempt to reverse-engineer, exploit, or abuse the Service.

4. Intellectual Property

Your Content. You retain ownership of any photos you upload. By uploading, you grant us a limited, temporary license to process your photo solely for the purpose of generating portraits.

Generated Images. Once you purchase a generated portrait, you receive a personal, non-exclusive license to use it for personal and commercial purposes (e.g., profile photos, social media, professional headshots). You may not resell the generated images as standalone products.

Our IP. The UPIC name, logo, website design, and underlying AI technology remain our intellectual property.

5. Payments & Refunds

All payments are processed securely through Stripe. By completing a purchase, you agree to Stripe's terms of service.

Due to the digital nature of the product, all sales are final. However, if you experience a technical issue that prevents you from receiving your purchased images, please contact us and we will work to resolve it.

6. Prohibited Uses

You may not use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, or harassing.
• Create deepfakes or misleading imagery intended to deceive others.
• Impersonate another person or misrepresent your identity.
• Violate any applicable local, state, national, or international law.
• Interfere with or disrupt the Service or its infrastructure.

We reserve the right to suspend or terminate access to any user who violates these terms.

7. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee that AI-generated portraits will meet your expectations, be error-free, or be suitable for any particular purpose. Results may vary based on photo quality, lighting, and other factors.

8. Limitation of Liability

To the maximum extent permitted by law, UPIC and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by updating the “Last updated” date at the top of this page. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
